Working together with other law firms, EKSM secured a $450,000 settlement with The Kendal Corporation, resolving data privacy claims arising out of the cybersecurity incident that occurred in June 2024. The claims, which sought an award of actual damages, compensatory damages, statutory damages, and more, were brought by our plaintiff on behalf of all individuals to whom Defendants mailed notices that their private information was potentially compromised in the data incident. Under the agreement, in which The Kendal Corporation did not admit to liability, the Defendant settled all disputes with a payment in the amount of $450,000.
