EKSM secured a $450,000 settlement with The Pisa Group, resolving alleged violations of the Telephone Consumer Protection Act. The claims, which sought an award of actual damages, compensatory damages, statutory damages, and more, were brought by our plaintiff on behalf of all persons who, within four years preceding the filing of this case, received more than one telephone solicitation call from The Pisa Group, within a 12-month period telemarketing newspaper subscriptions more than 31 days after registering their telephone number with the National Do-Not-Call Registry. Under the agreement, in which The Pisa Group did not admit to liability, the Defendant settled all disputes with a payment in the amount of $450,000 which is to be distributed on a pro rata basis.
Working together with other law firms, EKSM secured a $1,205,000 settlement with LivaNova USA, Inc., resolving data privacy claims arising out of the cybersecurity incident that occurred on or around October 26, 2023. The claims, which sought an award of actual damages, compensatory damages, statutory damages, and more, were brought by our plaintiff on behalf of all persons in the United States whose Private Information was compromised because of the October 26, 2023 Data Breach. Under the agreement, in which LivaNova USA did not admit to liability, the Defendant provides Settlement Class Members with the right to claim a cash payment through a $100 flat cash payment or a reimbursement of documented losses.
