Working together with other law firms, EKSM secured a $245,000 settlement with Elyria Foundry Holdings, resolving data privacy claims arising out of the cybersecurity incident that occurred in June 2024. The claims, which sought an award of actual damages, compensatory damages, statutory damages, and more, were brought by our plaintiff on behalf of all individuals whose personal information was compromised in the Data Security Incident discovered by Elyria, including those individuals who received notice of the breach. Under the agreement, in which Elyria Foundry Holdings did not admit to liability, the Defendant settled all disputes with a payment in the amount of $245,000.
